Dave, Jaising appear as SC says petitions seeking probe into Loya death raise serious questions

Amidst the attention caused by today’s events, the Supreme Court heard the petition seeking a probe into the mysterious death of Special CBI Judge BH Loya..A Bench of Justices Arun Mishra and Mohan Shantanagoudar heard the matter today, and later adjourned it to Monday, January 15..Interestingly, when it was taken up for hearing today, Senior Advocates Dushyant Dave and Indira Jaising requested the Bench not to proceed with the matter, since a similar petition had been filed in the Bombay High Court..“I beg your Lordships not to hear the matter” requested Dave..“We’ve heard you, please sit down” responded the bench..The Bench, before adjourning the matter, asked the counsel appearing for the state of Maharashtra to seek instructions. It also observed that the matter is serious and has to be heard..The petitions were sparked by an expose in The Caravan magazine, wherein the family members of the BH Loya – who was tasked with hearing the Sohrabuddin case – raised questions regarding the circumstances surrounding his death. BJP leader Amit Shah and several police officials were accused in the case..The hearing in this case assumes significance in the light of the press conference held today by four of the senior most judges of the Supreme Court. Earlier this morning, the judges revealed that the listing of the petitions filed by Tehseen Poonawalla and journalist BR Lone was one of the reasons they decided to hold the conference.
