Supreme Court refuses to stay Patna High Court decision to quash Bihar reservation law

The reservation for SC/STs and backward classes was increased to 65 per cent in 2023, reducing the open merit category to 35 percent. The decision was struck down by the Patna High Court in June this year.

The Supreme Court on Monday refused to stay the Patna High Court ruling that set aside the increase in reservation for Backward Classes, Extremely Backward Classes, Scheduled Castes and Scheduled Tribes (SC/STs) in Bihar from 50 per cent to 65 percent in public employment and educational institutions [State of Bihar and anr v Gaurav Kumar and Anr]
