The Supreme Court on Friday highlighted the poor quality of review and curative petitions being filed before it [PT Mohan vs Supreme Court]..A bench of Chief Justice of India (CJI) DY Chandrachud and Justice PS Narasimha made the observation while rejecting a plea seeking mandatory open-court hearing for all review petitions."If we start doing that then it will be the end of this court. But honestly I look at review petitions in the evening, which are pathetic. The fear is among all of these some good ones may be rejected. It is just filed at the behest of clients," the CJI remarked.Justice PS Narasimha weighed in saying,"Curative too, the quality of curative petitions also. A large number of lawyers giving approval for these when they should not." The Court then proceeded to dismissed the petitioner's case. Senior Advocate Gopal Sankaranarayanan said that Senior Advocates have started saying no to filing curative petitions in such a manner.A curative petition needs to be certified by a Senior Advocate before it can be filed in Supreme Court. "But a large number of lawyers are [still] giving approvals," the CJI replied.
