The Supreme Court has agreed to hear petitions filed by farmers seeking to halt the land acquisition procedure for India's first Bullet Train Project..The matter came up before the Bench of Justices Deepak Gupta and Aniruddha Bose, which today sought replies by the central and state governments..The land acquisition procedure for India's first Bullet Train project - planned to run between Mumbai and Ahmedabad - is currently underway..The petitions have been filed against the judgment of the Gujarat High Court which had, in September last year, upheld the validity of the amendment to the The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 through the Amendment Act of 2016..The land acquisition proceedings in question, which were admittedly initiated without jurisdiction by the Gujarat government, were also upheld by the High Court. The petitions point out that the appropriate government for the acquisition process as per the provisions of the 2013 Act is the Central Government..Further, the State of Gujarat had issued a notification in October 2018 which had, according to the petitions, sought to "cure the illegality in the action of the State of Gujarat". The validity of this notification was also assailed on the grounds of "malice and arbitrariness", but the same was also upheld by the High Court..Gujarat HC dismisses challenge to land acquisition for Bullet Train Project. The farmers have claimed that the High Court failed to appreciate the various aspects of the object and purpose of the 2013 Act in a welfare society such as India. The plea adds that the right to property is a right guaranteed under Article 300 of the Constitution of India and ensures right to fair compensation in case of acquisition by the State. While all these aspects will be under challenge before the Supreme Court, the petitioners have also sought a stay on the acquisition proceedings in the meantime till the matter is decided finally. The Supreme Court is scheduled to take up the matter for hearing next on March 20.[Read Order]
