State police can investigate UAPA offences till NIA takes over: Supreme Court

The Court clarified the NIA is said to have taken over the case from the State agency only upon receipt of cases papers from the State agency and not on mere renumbering of the case by NIA.

State investigating agency can probe into scheduled offences under the National Investigation Agency Act (NIA Act) including offences under Unlawful Activities Prevention Act (UAPA) till the NIA takes over the probe, the Supreme Court ruled on Wednesday (Naser Bin Abu Bakr Yafai v. State of Maharashtra).
