Siddharth Pithani, former roommate of Bollywood actor late Sushant Singh Rajput, and an accused in a case under Narcotic Drugs and Psychotropic Substances (NDPS) Act, has sought bail from Special Court for getting married. .Pithani submitted that he was getting married on June 26, 2021 and also annexed his wedding card with the bail application.Pithani was arrested by the Narcotics Control Bureau (NCB) in the drug case being probed in connection with the death of Rajput and had been remanded to judicial custody till June 18, 2021.Pithani claimed that from the period of June to September, he had been attending the office of the Central Bureau of Investigation (CBI) for 20 days and the Enforcement Directorate (ED) office for 2 days. .In his bail application filed through Advocate Tareq Sayed, Pithani submitted that he was never found to be in possession of any contraband whatsoever, which was an admitted position. Further, there was neither any incriminating material to suggest that he was involved in dealing of any narcotic drug or psychotropic substance. He contended that NCB's case was based on a statement made by the co-accused in the case, Samuel Miranda and Dipesh Sawant who claimed Pithani had purchased ganja/ weed to smoke. This statement had also been retracted by them on the first day of remand.Pithani claimed that the co-accused in the case had been released on bail irrespective of the fact whether they had been found in possession of any commercial quantity or not. In his bail application, Pithani also relied upon the judgment passed by the Bombay High Court in the bail application filed by Rhea Chakraborty to contend that the allegation of buying and selling of ganja does not fall within the scope of Section 27A (financing drugs or substances or harbouring offenders) of the NDPS Act..Pithani, a prime suspect in the case, had been absconding for long, claimed NCB. He was staying in the same flat as Rajput and he was one of the first persons to see him dead.He had been summoned thrice before he was finally nabbed in Hyderabad on May 26, 2021.He was arrested for offences punishable under Sections 8(c), 20(b)(ii), 22, 27A, 28, 29 and 30 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.After obtaining a transit warrant from the CMM Court at Hyderabad, Pithani was produced before the CMM at Esplanade, Mumbai.He was remanded to NCB custody till June 1 and thereafter remanded to judicial custody which was extended till June 18, 2021.
