Salman Khan seeks contempt action against Kamaal R Khan for continuing "defamatory remarks" despite undertaking in Mumbai Court

Bollywood actor Salman Khan has sought contempt action against Kamaal R Khan for continuing to make defamatory remarks against him despite the latter's undertaking not to do so before the Bombay City Civil Court..The application seeking contempt action was filed in the actor's defamation suit to restrain KRK from directly or indirectly making and uploading videos or other content on Salman Khan, his business ventures and their films/projects, including the latest film 'Radhe'.When the matter was heard last, KRK, through his lawyer Manoj Gadkari, had stated that no defamatory remarks will be made till the next date of hearing.However, despite such statement, Khan contended that KRK continued to publish contemptuous tweets. .The application stated that the reason for KRK to continue making defamatory remarks despite his statement was to earn monies from his social media accounts at the cost of defiance of the court's orders..Advocate Pradeep Gandhy, appearing for Khan, partly argued the application before Additional Sessions Judge CV Marathe today.Due to paucity of time, the hearing was adjourned to Friday. The earlier statement made by KRK will continue to operate till then..The application raised grievance against allegedly contemptuous tweets calling Khan a "career destroyer", "Gunda bhai", etc. The content was also posted by KRK on his YouTube and Instagram channels..It was further claimed that KRK tweeted about an incident when someone broke into his house, implying that the act was committed by Khan to scare him.This sort of false information, the application states, maligned Khan's reputation and defamed him..The application stated that on a mere perusal of the order and the alleged contemptuous material, it was clear that KRK acted in flagrant violation of the order of the City Civil Court. KRK's action aggravated the grievance further, according to the plaintiffs, as there had been a clear acknowledgment by him on his social media about the statement made by his lawyer on his behalf in the Court..In view of the published material, it was evident that KRK has "no regard whatsoever for the order and he was repeatedly, wilfully committing contempt by making defamatory remarks against Khan," the application stated.The allegedly contemptuous remarks "tend to lower the authority, dignity and intellectual character of this Court before the masses at large" and also interfere with the proceedings before the Court, the application stated..The application has sought for the following prayers:To detain KRK in civil prison as per provisions of the Code of Civil Procedure,To ensure personal presence of KRK either by issuing bailable or non-bailable warrants,To forthwith withdraw and/or recall and/or take down all contemptuous content..Khan and his business venture were represented by Gandhy, who was briefed by a team from DSK Legal including Managing Partner Anand Desai, Partner Chandrima Mitra and Associate Partner Parag Khandhar.
