Former Mumbai Police cop Sachin Waze has moved the Bombay High Court seeking temporary house arrest till such time he recovers after his recent bypass surgery..Waze is a prime accused in the case connected to the explosives-laden SUV found outside Reliance Industries Chairperson Mukesh Ambani’s residence and the death of businessman Mansukh Hiren. He was recently allowed by the National Investigation Agency (NIA) Court to be admitted to a private hospital for a bypass surgery. .The Special NIA Court had earlier rejected his application seeking house arrest. The Special Judge had directed that Waze be transferred to Taloja Central Prison immediately and kept for a month in the prison hospital. The Court also clarified that as per previous directions, Waze can be given home-cooked food and shifted to JJ Hospital, if required. Challenging this order, Waze moved the High Court through Advocate Rounak Naik. .In his plea before the High Court, Waze sought for temporary 'house custody' to enable him to recover in a safe, sterile and stress-free environment. He contended he should not be sent back to Taloja Jail, where he will not get post-operative care and could be exposed to more infections..Advocate Sudeep Pasbola, appearing for Waze, informed the Court that Waze had been moved out of the hospital at dawn on October 6, 2021. Special Counsel Sandesh Patil, appearing for the NIA, sought for time to respond to the application. .Accordingly, the Bench of Justices Nitin Jamdar and SV Kotwal granted a week's time to NIA to file its reply and posted the matter for hearing then. .Waze's plea highlighted the observations made by the Bombay High Court on the abysmal jail conditions at Taloja Jail in its order granting interim bail to Bhima Koregaon accused Dr. Varavara Rao, who was lodged in the same prison as Waze..Waze submitted that the conditions in prison hospitals were so poor that there was a high risk of contracting other infections such as tuberculosis etc. His health would be jeopardised if he is taken back to Taloja Jail, he claimed..The room where he intends to stay at his residence (in the event house arrest is allowed) has separate access, and as such, complete seclusion could be maintained in order to enforce the rules as per prison manual, the plea stated.
