A representation has been made to Rahul Mehra, Standing Counsel (Crl), Delhi, seeking his consent for initiation of criminal contempt against a CBI officer who allegedly hit a public prosecutor..The representation has been made by Advocate Amit Sahni under Section 15 of the Contempt of Courts Act, 1971..The officer against whom contempt action has been sought is Raghavendra Vats, DIG, CBI..As per media reports, Vats “punched and strangulated” a CBI prosecutor inside CBI headquarters over the delay in framing of charges against former Secretary to Chief Minister Arvind Kejriwal in a corruption case..It is Sahni's assertion that Vats has caused deliberate obstruction in the administration of justice..“political compulsions cannot license any CBI officer to abuse its power in such a manner to the extent of beating/strangulating an advocate/public prosecutor ..for not accelerating the framing of charges pending before the Special Court, CBI, New Delhi.”, it is added. .Sahni has also informed that the victim prosecutor has even made a police complaint. .Sahni has also written to the Bar Council of India, urging it to take appropriate legal action against Vats..He has asserted that it was incumbent upon Bar Council of India and all Bar Associations to stand with the victim lawyer and to uphold the dignity of legal profession and rule of law..In the representation to BCI, Sahni has stated,“..the facts of the case invite the intervention of this Hon’ble Council and Bar Associations as the aforesaid officer is not only liable to be prosecuted under the provisions of the Indian Penal Code, 1860 but has also caused deliberate obstruction in administration of justice and the applicant has also sought consent from Shri Rahul Mehra ..under Section 15 of the Contempt of Courts Act, 1971 ..and the said consent is awaited.”.Read the representation:
