Businessman Raj Kundra, arraigned as accused in the porn film case, has moved a Mumbai Court seeking regular bail on the ground that the investigation pertaining to him has now been completed by the Mumbai Police. .The Crime Branch of the Mumbai Police has filed a detailed supplementary chargesheet against four persons, including Kundra, arraigning them as accused. .Kundra claimed that upon filing of the chargesheet, it was evident that the investigation against him is completed and hence he was now entitled for bail. .Kundra submitted that after the primary chargesheet had been filed against nine accused, eight had been granted bail by the Court. Through an application filed by Advocate Prashant Patil, Kundra has now sought for bail citing parity with the co-accused. .Kundra further argued that even though there was not an iota of evidence against him in the first chargesheet, he was arrested and that after a "motivated investigation" the supplementary chargesheet came to be filed. .Some of the grounds for seeking bail in Kundra's application are as follows:That Kundra is a permanent resident of India with deep roots in the society.That Kundra was associated with the company which owns the mobile apps - Hotshot and Bollyfame - only for a period of 10 months approximately. "During this period, the Applicant had interacted with few clients of AMPL, but had never taken any active part in contract building or any of the content creation", Kundra contended.That from a bare perusal of the statements of the "so-called witnesses", it is evident that the victims were adults, and had voluntarily acted in the "so-called video shootings". That the unprecedented COVID-19 pandemic situation has exposed him to potential health hazard..Kundra was arrested by the Mumbai Police and produced before the Metropolitan Magistrate at Esplanade, who remanded him to police custody till July 23, 2021,which was extended till July 27.His bail application was rejected on July 28, 2021 by the Magistrate Court..Kundra has also approached the Mumbai Sessions Court seeking bail after the Magistrate Court rejected his bail plea.The Sessions Court issued notice and police also filed a reply opposing the bail application.
