A petition has been filed before the Delhi High Court seeking criminal action against Twitter India and its representative for being involved in the conspiracy to promote Khalistan Movement.(Sangeeta Sharma vs UOI).Petitioner, Sangeeta Sharma has sought a direction for lodging a case against Twitter Communications India Pvt Ltd and its officials, Raheel Khurshid and Mahima Kaul for commission of offences under Section 39 Unlawful Activities (Prevention) Act, 1967, Sections 107, 121A, 124A, 153A, 153b and Section 34 of Indian Penal Code and Section 66F of the Information Technology Act, 2000. .Respondent No 5 (Twitter Communications India) is culprit of spreading Khalistani movement and anti-nationl agenda to public at large.the Petition reads. .The Petitioner has asserted that in the absence of a mechanism to regulate content/news on social media, Twitter platform is being used to call upon “separatists”, which is “creating panic in some sections of the society, challenging the unity, integrity and sovereignty of Union of India”..“Respondent No 5’s server were used for the promotion of #Khalistan, still there there were many users who are having their user name as Khalistan or similar to Khalistan just to promote the anti-national activity..”, the Petitioner has stated. .The Petitioner has claimed that Twitter has “abetted” the act of the separatists by accepting financial gratification and paid advertisements..“The brazen attack on sovereignty and integrity of India on Twitter platform is to the detriment to the citizens as a whole.”the Petition reads. .The Petitioner has also submitted that in spite of the issue of Twitter's "anti-national acts" been raised by Member of Parliament, Anantkumar Hedge, no "serious action" was taken by Twitter..It is further claimed that the management of Twitter India is not neutral and that the platform is "unabashedly and unequivocally against the present government". .In view of the above, the Petitioner has sought an investigation by the National Investigating Agency against those who are promoting pro-Khalistan messages on Twitter..A direction is also sought to Central Government to check and regulate content and advertisement on social media..Today, the matter was listed for hearing before a Division Bench of Chief Justice DN Patel and Justice Prateek Jalan..The Chief Justice, however, directed that the matter be placed before the Divison Bench headed by Justice Hima Kohli. The matter would be heard next on September 30.
