Plaintiff should prove readiness to perform his part of contract for obtaining relief of specific performance: Supreme Court

The Court said that for the relief of specific performance, the plaintiff has to prove that all along and till the final decision of the suit, he was ready and willing to perform his part of the contract.

The Supreme Court recently observed that for seeking relief of specific performance, the plaintiff has to prove that all along from the date of execution of the agreement till date of decree, he was ready and willing to perform his part of the contract [UN Krishnamurthy (since deceased) through LRs v. AM Krishnamurthy].
