More than sixty-five candidates, who appeared for the Madhya Pradesh Civil Judge Exam 2019, have moved the Madhya Pradesh High Court challenging the results of the preliminary exam declared in May 2021. .The petitioners, through the plea filed through advocate Prashant Manchanda, sought re-computation of marks after correcting the flawed answer key and also prayed for reassessing the merit list. .It was the petitioners' argument that the answer key published in March 2021 was accurate. However, in the revised final answer key published in May 2021, the respondents modified the answers and assigned wrong responses..The petitioners alleged that they were unfairly excluded from the list of successful candidates after modification of answers and deletion of correct answers led to a flawed answer key.It was contended that if re-computation of marks is not carried out, the petitioners’ fundamental rights under Article 14 and 21 of the Constitution will be violated..In this regard, the petition listed out details of several questions where the examination key made erroneous modifications and provides for a rationale with respect to the correction of each error..“It is humbly submitted before this Hon’ble court that in the face of glaring and demonstrably wrong answers provided to perfectly correct questions is fallacious as it leads to exclusion of a number of petitioners from qualifying the exam who, after applying their legal acumen and intelligence had chosen the accurate answers. Thus, it the mistake must be undone to save the petitioners/ candidates from injustice and inequity,” the petition said. .Further, the petitioners also emphasised on the importance of the examination and why it would be necessary to maintain high accountability. “The judicial functions discharged by the judicial officers sets the standards for the judicial system and impartial flow of the judicia l process, therefore, considering the post for which the candidates are to be selected, the selection process including the examination should also stand the test of purity devoid of any confusion deciding a fact on extraneous considerations by drawing a presumption,” the petition stated. .The plea, therefore, prayed for quashing of the earlier list of selected candidates and preparation of fresh list after re-computing marks based on corrected answer key.
