Notice issued in plea challenging SC judgment upholding WB Madrasah Service Commission’s power to nominate Madrasa teachers

On January 6, the Bench of Justices Arun Mishra and UU Lalit upheld the constitutionality of the West Bengal Madrasah Service Commission Act, 2008. This judgment has been challenged as contradicting the TMA Pai Foundation case, as well as the Supreme Court's September 2019 ruling in Chandana Das (Malakar) v.State of West Bengal.

The Supreme Court today issued notice in the petition filed challenging the correctness of the two-Judge Bench judgment rendered earlier this month, in which the constitutionality of Sections 8, 10, 11 and 12 of the West Bengal Madrasah Service Commission Act, 2008 (2008 Act) was upheld.
