Mika Singh moves Bombay High Court to quash molestation case for forcibly kissing Rakhi Sawant

Singer Mika Singh has approached the Bombay High Court seeking quashing of a molestation case filed by actor and model Rakhi Sawant in 2006. .Singh submitted that the two have amicably and conclusively resolved their differences and, therefore, sought quashing of the first information report (FIR) and chargesheet with the consent of Sawant..A division bench of Justices AS Gadkari and PD Naik was informed by Sawant’s lawyer, advocate Ayush Pasbola, that Sawant’s affidavit was misplaced by the registry of the High Court and was thus untraceable. “She (Sawant) is busy with her professional engagements. But the two have resolved their differences, so she has no objection to quashing of the FIR that had been registered by her,” her lawyer submitted. .The bench granted Sawant a week’s time to file a fresh affidavit..The FIR was registered on June 11, 2006 after the incident took place during Singh’s birthday party.Singh allegedly forcibly kissed Sawant at his birthday party at a restaurant in Mumbai suburbs. The incident was widely reported with the video footage and still photographs of the party of the time when the alleged incident took place. Based on the complaint, Singh was booked for offences under sections 354 (molestation) and 323 (assault) of the Indian Penal Code.Singh had been missing a few days after the incident. He approached a sessions court for anticipatory bail which was granted on June 17, 2006..In his plea before the High Court, Singh stated that the two parties had settled their dispute amongst themselves and Sawant had even sworn on an affidavit giving her no-objection to granting relief mentioned in the petition.Advocate Falguni Brahmabhat, appearing for Singh, apprised the court that the case has been lying in limbo for the past 17 years. “Though chargesheet has been filed against the accused (Singh), charges are yet to be framed. Singh and Sawant have buried the hatchet, have resolved their issued and are friends now", she informed the Court..The plea will be heard on April 17.
