Metropolitan Magistrate JY Ghule, Mumbai on Friday ordered the Police Inspector Bandra, to take cognizance of the offences committed by Bollywood actress Kangana Ranaut and her sister Rangoli Chandel in a complaint filed by one Munnawarali Sayyed.
The allegations are based upon comment on the electronic media i.e. twitter and interviews.
The Court ordered:
Thorough investigation is necessary by the expert. All offences alleged and levelled against the accused are cognizable. Search and seizure is necessary in this case. In such circumstances, I found it is proper to pass an order under Section 156(3) of the Code of Criminal Procedure. Hence proceedings be sent towards the concerned police station for necessary action and investigation.
In his plea before the magistrate, Sayyed sought directions from the Court to the Bandra Police to register a complaint against Ranaut and Chandel for committing offences punishable under sections 153A (promoting enmity between different religious groups), 295A (maliciously outraging religious feelings), 124A (sedition) read with 34 (conspiracy) of Indian Penal Code.
Sayyed alleged in his complaint that Kangana Ranaut was putting up objectionable comments on her Twitter handle and making statements in interviews against the the Bollywood film industry which was hurting his and colleagues sentiments.
He added that Chandel was uploading statements on Twitter with an intention to incite feelings and spread communal tension amongst different religious groups.
Sayyed also raised concerns against the statements on twitter against he Chief Minister Uddhav Thackeray and the Maharashtra Government agencies. He alleged that the sister-duo are trying to create “disaffection in citizens against the Maharashtra Government”.
Sayyed approached the court through Advocate Ravish Zamindar after the Sub Inspector of Police in Bandra refused to take cognizance of his grievances against the inciting tweets of Kangana Ranaut and Chandel.
