The Kerala High Court, on Thursday, took exception to the stance taken by the Central government that it cannot admit a Transgender person to National Cadet Corps (NCC) since only males and females are eligible for the same (Hina Haneefa v. Union of India).
A single-judge Bench of Justice Devan Ramachandran said that the stance by the centre cannot be acceded to in the light of Kerala's Transgender Policy as well as the applicable statute.
"A person cannot be denied a legitimate right only because she is a transgender," Justice Ramachandran remarked.
