Justice Paresh Upadhyay on Tuesday bid farewell to the Madras High Court after attaining superannuation. .In less than a year as a judge of the High Court, Justice Upadhyay disposed of 2,533 cases.Among his most notable verdicts was the dismissal of an appeal by SpiceJet challenging an order that directed winding up of its operations and attachment of its assets..Speaking at the farewell function organised by the High Court, Tamil Nadu Advocate General R Shunmugasundaram thanked Justice Upadhyay for all his work at the Madras High Court.Shunmugasundaram also mentioned that he had come to know that Justice Upadhyay had returned to the government, the entire sum of ₹3.5 lakh that he had received as allowance that a judge is entitled to when transferred out of his or her parent court."I asked him the reason, and he simply smiled and said that he returned the money because he never felt that while in Tamil Nadu, he was ever out of his home State," Shunmugasundaram said..Tamil Nadu Chief Minster MK Stalin also issued a written communication, saying that the entire State had benefitted enormously from Justice Upadhyay's "rich, reasoned, and remarkable judgements," during his brief tenure as a judge of the Madras High Court. In his speech Justice Upadhyay said,"Theoretically, upholding law should lead to doing justice but that may not be true always. As judges, we are often faced with a situation where either the law will be upheld or justice will be done. I have tried my best to do justice with the aid of the law when available, without such aid if required, and sometimes even beyond it if necessary."Justice Upadhyay also said that while taking oath as a judge of the Madras High Court in 2021, he had said that he would not let his unfamiliarity with the Tamil language become a burden for the litigant or, the State. He revealed that he and his wife took Tamil lessons from a home tutor."Due to time constraints, I could not devote all of my energy to the lessons, but my wife certainly did better than me," he said..The judge recounted that he began his career as a lower division clerk in a government office who could never have dreamt at the time of holding the prestigious office of a High Court judge. "But destiny had other plans and God has been kind," Justice Upadhyay said.He also specifically expressed his gratitude to former Madras High Court Chief Justice Sanjib Banerjee for reposing trust in him on the very first day that he took over as a judge here..Justice Upadhyay was transferred to the Madras High Court from the Gujarat High Court in October 2021, where he was appointed as an additional judge in 2011, and was made a permanent judge in 2013.
