Juhi Chawla withdraws plea before Delhi High Court in relation to judgment on 5G rollout

Cine actor Juhi Chawla on Thursday withdrew the plea filed by her before the Delhi High Court seeking changes to the June 4 judgment delivered by the Court dismissing her plea challenging rollout of 5G technology in India ( Juhi Chawla vs Science and Engineering Research Board)..Chawla had filed the present application praying that her suit on 5G rollout should be considered as "rejected" and not "dismissed". She had sought changes to that effect in the June 4 judgment. When the matter came up for hearing on Thursday, advocate Deepak Khosla representing the bollywood actress, sought liberty to withdraw the application, which was granted by the Court. .Juhi Chawla along with Veeresh Malik and Teena Vachani (plaintiffs) had earlier filed a suit before the High Court, arguing that until and unless 5G technology is "certified safe", its roll out should not be permitted.They had argued that it was an established fact that there "could be danger of imminent nature" due to 5G and as per RTI responses, no studies had been conducted on the same.Justice JR Midha had dismissed the same on June 4 while imposing cost of Rs. 20 lakh on Chawla and others, labelling it as 'frivolous litigation', an 'abuse of process of law' and a publicity stunt.The Court had also pointed out the several lapses in Chawla's plaint in terms of the Code of Civil Procedure (CPC) while dismissing the suit.Subsequently, Chawla had filed three applications in relation to the case - for refund of court fees, waiver of costs and for changing the word "dismissed" to "rejected". The first two applications were withdrawn by Chawla on July 7 after the Court had taken strong objection to the same. ."The Court is shocked with the conduct of the plaintiff. Firstly, this is a frivolous action and secondly, the Court has gracefully granted the plaintiffs permission to withdraw with application on costs which they haven't even deposited.
