[COVID19] Will inmates out on interim bail continue to reap the benefit of extension of interim orders? Delhi High Court to pass order

Senior Standing Counsel (Crl) Rahul Mehra today informed the Delhi High Court that at present 6,711 inmates are out of jail on account of interim bail or parole. (Court on its own motion vs State: Re Extension of interim orders)..2,318 inmates involved in heinous crimes and 2,907 inmates involved in minor crimes were granted interim bail. 518 were granted interim bail by High Court.the Delhi High Court was informed. .Mehra added that while jails have a total capacity of 10,000, the present strength was almost 16,000. .In response to the query on the number of infected inmates in jails, Mehra also informed that as of today, only 3 inmates were infected from the virus and were in LNJP Hosp. .A three-Judge Bench of Chief Justice DN Patel, Justice Siddharth Mridul and Justice Talwant Singh was considering a plea for modification of its earlier order on extension of interim bail orders till October 31, 2020 in view of COVID-19..Delhi HC issues notice in plea to modify order extending interim bail till October 31.The modification plea was moved by Special Public Prosecutor for Delhi riots cases, Amit Prasad on the basis that the order was being misused by riots-accused. .Today, he clarified that his concern was only with regards to the automatic extension of interim bail for 25 accused in Delhi riots cases..After hearing Mehra and Prasad, CJ Patel suggested doing away with automatic extension of interim bail as at present, only 3 inmates were infected with COVID-19 and they were in a hospital. ."We were not concerned with jail capacity etc (when we passed the order).. we were only concerned with COVID. Since there's nothing like COVID now (in jails), this is over". CJ Patel said. .[BREAKING] Delhi High Court extends interim orders till October 31.Mehra, however, submitted that modification of the extension order would be against the order of the Supreme Court to decongest jails.."COVID-19 is not over in Delhi..There is nothing on record to show that the decongestion caused anarchy", Mehra remarked. ."Let us end the order that they should not surrender for COVID purposes.. it is still open for High Powered Committee; High Court is open, trial court is open. Govt may release on parole", Chief Justice Patel further opined. .During the course of the discussion, Justice Talwant Singh suggested that the order may be modified only qua those who are accused of heinous crimes and were released on interim bail on account of non-COVID reasons. .As the two judges discussed the possible outcome in the present case, Chief Justice Patel adjourned the hearing and stated that an order would be passed after discussion.
