[Baal Shiv piracy case] Zee Entertainment tells Bombay High Court broadcast of show will be deferred till September 15

Zee Entertainment Enterprises Ltd made a statement before the Bombay High Court on Friday that it will defer broadcasting of the television series 'Baal Shiv - Mahadev ki Andekhi Gatha' till September 15, 2021 in view of the copyright infringement suit filed by a writer and mythologist, Chotenlal Saini. .Justice Gautam Patel permitted Zee to continue with the promotions and trailers of the show which would expressly include publishing the rescheduled date on which the show broadcast will begin. "On a specific order, Zee submits that without prejudice to its rights and contentions, it will reschedule the launch of their TV Show until September 15, 2021. This is without prejudice to their contention. The injunction will depend on the order that will be passed on the interim application," Justice Patel recorded in the order. .The plaintiff, Chotenlal Saini had approached seeking an order of injunction against Zee to perpetually restrain them from releasing the series.Saini, termed it a case of piracy, stating in his petition that he had first conceptualised the idea of 'Baal Shiv' and had contemplated making a television series out of the same.Saini purportedly communicated his fleshed out idea to the representatives of Zee under express confidentiality..Justice Patel had told Senior Advocate Virag Tulzapurkar appearing for Zee on Thursday to either make a statement right away that the series will not be released till the matter is heard or face a court order restraining Zee from releasing the series.When Tulzapurkar refused to make such statement, the Court listed the matter for hearing today. .[Baal Shiv piracy case] Indian mythologist approaches Bombay High Court seeking injunction against Zee Entertainment.Opposing the application for injunction, Tulzapurkar submitted that based on a short teaser of 40-50 seconds, Saini could not have concluded that his purported entire work has been plagiarised. He contended that the concept of "Baal Shiv" was not Saini's novel idea as claimed by him, but it had been floating in various films, TV shows (by a different channel) of which one of the respondents had been a part of.He also showed the Court that the episodes to be aired over a span of 3 months had already been prepared while Saini's concept had not even been fleshed out. .Senior Advocate Venkatesh Dhond appearing for Saini submitted that over the course of more than one meeting, Zee had encouraged Saini's concept and based on such encouragement Saini had begun to flesh out his idea. He also added that if Saini can see the episodes, then he will be in a better position to bring evidence to the Court about the portions allegedly plagiarised. .Justice Patel concluded that before any further hearing is granted, it is important that Saini be given an opportunity to view the show to make his submissions on the issue of plagiarism. Justice Patel directed Zee to ensure that the first 10 episodes are shown to Saini at the earliest. Saini was also directed to abide by the confidentiality agreement clauses that Zee Entertainment will ask Saini to sign before the episodes are shown to him at a location that Zee Entertainment will choose. .Saini was represented by Senior Advocates Venkatesh Dhond, Dr. Birendra Saraf and advocates Rashmin Khandekar instructed by advocate Tushar Gujjar from SL Partners.Zee was represented by Tulzapurkar along with advocate Hiren Kamod, instructed by advocates Anushree Rauta, Punit Jani, Navankur Pathak, Narayani Choudhary from ANM Global.
