Illegal detention, custodial violence not discharge of 'public duty'; cannot claim protection under Section 197 CrPC: Karnataka High Court

The Court ruled that if the authority vested in a police official is misused for doing things which are not otherwise permitted under the law, such acts cannot claim the protection of Section 197 CrPC.

The Karnataka High Court recently held that illegal detention of an innocent person and subsequent custodial violence and torture cannot be termed as act done in connection with discharge of public duty by a police officer (S Shivakumar v. State of Karnataka).
