The Supreme Court recently reiterated that the High Courts too are Constitutional Courts and cannot be regarded as subordinate to the Supreme Court [Shankar Kumar Jha v. State of Bihar and Others]..A division bench of Justices Abhay S Oka and Ahsanuddin Amanullah made the observation while considering a plea urging for directions to the Patna High Court to decide on a pending writ petition in a time bound manner..The Supreme Court dismissed the petition, opining that it is ultimately for the concerned High Court to fix its own priorities in considering pending cases. "It may be noted here that the High Court is also a Constitutional Court and is not subordinate to this Court. Every High Court has a different scenario when it comes to pendency of old cases. It is ultimately for the concerned High Court to fix its own priorities considering the pendency of cases," the Court said..The bench proceeded to opine that the petitioner has to approach the High Court for relief.
