In a step towards transparency and accountability, the Gujarat High Court has decided to begin pilot implementation of auto-listing certain categories of fresh cases with effect from July 7, 2022..A notice issued by the High Court on Tuesday provided details the methodology of the auto-listing in line with directions by Chief Justice Aravind Kumar."As directed by Hon'ble the Chief Justice Mr. Justice Aravind Kumar, the following methodology is being implemented for the pilot implementation of Auto Listing of certain categories of fresh matters from cause list to be published for 7th July, 2022 onwards," the notice said..Th following three categories of matters will be considered for auto-listing in the causelist:These will include:1. Regular bail applications and criminal appeals under The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 will be listed on 2nd day of filing;2. Anticipatory bail applications and criminal appeals under The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 will be listed on 3rd day of filing;3. Quashing petitions under Section 482 of the Criminal Procedure Code and special criminal applications under Articles 226 and 227 of the Constitution will be listed on 3rd day of filing;.The notice clarified that the number of days will be counted from the next court working day after the matter is filed, and will not include Saturdays and holidays. .Pertinently, unlisted fresh matters, irrespective of registration, stage and objections would be listed at the most by the days specified. "Thus, if the matter is ready and does not have any objections therein, the same shall also be listed in regular course which may be even before the aforesaid day but shall not be later than the aforesaid auto listing day", reads the notice..The cases will be listed in a cause list names "Auto Listing Board", and advocates in the matters will be notified as per regular course by way of alerts on their email and via SMS. .[Read Notice]
