"Even if there is suspicion against a person, if sufficient evidence cannot be collected to send him for trial, it would be a futile exercise to conduct further investigation into the same aspects," the Court said.
The Kerala High Court recently held that further investigation cannot be ordered merely for the reason that there are contradictions in the statements given by witnesses during the preliminary enquiry (Asoka Kumar S v. State of Kerala and Ors.).
