[Delhi Riots] Delhi Police move Delhi High Court challenging bail granted to Congress councillor Ishrat Jahan

The Delhi Police has moved the Delhi High Court challenging the special court order granting bail to Congress councilor Ishrat Jahan in a case related to North-East Delhi riots of February 2020..The plea will be heard on Thursday by Justice Anu Malhotra..In its appeal, Delhi Police has argued that the lower court ignored the evidence and statements which were produced before it and passed the order "discarding the evidences which clearly made out a sinister plot of engineering mass-scale violent riots" in the national capital. "It is also pertinent to note here that that the said riots did not occur in the spur of moment or due to fit of communal anger but was pre-planned in multi-layered, multi-organizational fashion," read the plea. It stated that the timing of the riots was meticulously chosen by the Jahan and other co-conspirators with the visit of American President so as to garner the attention of international media."All the preparation of riots such as stocking of arms, stones etc were done in advance and upon the arrival of the American president under a deep-rooted conspiracy operating on various levels, in guise and under the cloak of right to protest disruptive chakka jam were organized, people from a particular community were gathered, indoctrinated, mislead by instilling fear in them that they would lose their citizenship if CAA was implemented and thus a super charged environment was created which forced the innocent to take arms into their hands," the Court said. .The plea further argued that the lower court's order was not only in the teeth of the settled of law, but suffered from infirmities which go to the root of the matter..Jahan was arrested in March 2020 in connection with a Delhi Riots case for the alleged commission of offences under provisions of the Indian Penal Code, Prevention of Damage to Public Property Act, Arms Act and the Unlawful Activities Prevention Act (UAPA). She had subsequently filed a bail application before the Special Court.The prosecution had contested the maintainability of the same, contending that such a plea filed under Section 439 of the Code of Criminal Procedure (CrPC) could not be entertained by a special court.During an earlier hearing, Special Public Prosecutor Amit Prasad had argued that Jahan was in touch with other accused with whom she had no connection and the same was only to further the object of conspiracy to commit riots.In July last year, the Delhi High Court dismissed the former Congress Councillor's petition against the extension of time period to conclude the investigation in the case against her..[Delhi Riots] Ishrat Jahan did not create idea of Chakka Jam; not part of incriminating WhatsApp groups: Delhi court bail order
