The Delhi High Court on Monday stayed a trial court order setting aside the Look Out Circular (LOC) against Huawei India’s chief executive Xiongwei Li [Deputy Director of Income Tax (INX) v Xiongwei Li]. .Justice Anu Malhotra noted that the Income Tax Department had placed before the trial court a sealed envelope containing a copy of its letter written to the authority for issuance of LOC and it is essential for her to examine the same as well.The court directed the Income Tax Department to submit the same and reserved the matter for orders..Justice Malhotra said that the order will be pronounced on Thursday and till then there will be stay on the order of the trial court.“The matter is reserved for orders on the application seeking the stay of the impugned order and is directed to be listed on 15.09.2022 for pronouncement, till which date the operation of the impugned order is stayed,” the court has said..The Income Tax department has alleged that the top Huawei executives including its CEO are withholding important information on tax evasion in some of the important cases.On May 1, 2022 Li was also stopped from travelling abroad by the department as well..Advocates Zoheb Hossain, Vipul Agrawal and Parth Semwal appeared for the Income Tax Department.Advocates Vijay Aggarwal, Nagesh Behl, Hardik Sharma, Abhiraj Ray and Mukul Malik appeared for Li.
