The Delhi High Court recently restrained a website by the name of ‘Hindustan Times Marathi’ from using a logo, mark or domain name that was deceptively similar to that of Hindustan Times..Justice Jyoti Singh has further directed that its website ‘www.hindustantimesmarathi.com’ shall either be suspended or access to it should be blocked by the internet service providers..The Court was dealing with a suit filed by Hindustan Times Media Limited seeking an ex-parte ad-interim injunction against the website, which is primarily and substantially engaged in publishing, hosting, communicating, news, articles, stories and columns in Hindi and Marathi languages to Indian readers and viewers.It was argued that mark used on the defendants’ website is in a manner and style which is deceptively similar or nearly identical to that of the Hindustan Times' mark and is therefore aimed to deceive and confuse the consumers..After hearing counsel for Hindustan Times, Justice Singh said that there was a prima facie case in their favour for grant of ex parte ad-interim injunction and the balance of convenience also lay in its favour as irreparable loss will be caused to it if access to the website is not blocked.The Court has also issued summons to the defendants, asking them to file its response within a month.The case will now be heard on August 25..Advocates Saikrishna Rajagopal, Sidharth Chopra, Nitin Sharma, Vivek Ayyagari and Angad Makkar appeared for Hindustan Times..[Read Order]
