The Delhi High Court on Monday refused to entertain a challenge to the exemption given to government functionaries and their staff members from carrying a negative RT-PCR report while travelling from Maharashtra to Delhi via air. .A Division Bench of Chief Justice DN Patel and Justice Jasmeet Singh said that the petitioner should be aware what "war-like situation" is. "Doctors have to be called overnight. Look at the pandemic situation.. war-basis work has to be done.".The Court thus stated that in view of the prevailing situation, there is no need for negative RT-PCR test from doctors, nurses, officers etc. ."Throwing stones at the government's work! Let the government to its work," the Court remarked as it stated that it would dismiss the petition with heavy costs. .As per the petitioner, Sudhir Garg, no "general exemption" could be given to the government and constitutional functionaries while travelling to the national capital from Maharashtra. .The petitioner contended that giving such an exemption negated the whole exercise of calling for negative tests from other passengers. .The petitioner also pointed out that there were a large number of flights that travelled from Maharashtra to Delhi. .After hearing the Court's opinion, the petitioner proceeded to withdraw the PIL.
