Delhi HC issues notice in Chandra Shekhar Azad's plea for reduction of time period for inviting objections to his political party

The Delhi High Court today issued notice in a plea by Bhim Army Chief, Chandra Shekhar Azad seeking a direction to the Election Commission to reduce the time period for inviting objections to his political party 'Azad Samaj Party (Kanshi Ram)'. (Chandra Shekhar vs Election Commisison)

Notice to the Election Commission was issued by a Single Judge Bench of Justice Jayant Nath.

Azad has moved the Court in view of the upcoming Bihar Elections.

Counsel for Azad, Advocate MS Arya informed the Court that in March 2020, an application was filed for the registration of Azad's political party.

While the entire process, post completion of all requirements, was completed on August 13. 2020, the application was approved only in September.

Following the approval, for the purposes of allocation of a party symbol, Azad was mandated to publish a public notice in newspapers for inviting objections to his political name.

It is Azad's concern that if the statutory time period of 30 days for inviting objections is followed, the party would not be able to participate in the Bihar Elections which is slated to begin from October 28.

The petitioner and the workers of the party are making sincere efforts to participate in Bihar Elections and by-elections in other States. But if the processing period of 30 days is not reduced, the petitioner may not be permitted to participate in the Assembly elections of Bihar State under the name and party of his party.
It is stated.

Stating that irreparable loss would be caused to him if the process is not expedited, Azad has prayed that the only seven days be given to the public to raise objections.

A direction is also sought for immediate allotment of a party symbol.

While the counsel for Azad pressed for an interim order, the Court refused to do so in the absence of Election Commission's counter affidavit.

Counsel for Election Commission, Advocate Rajeev Sharma opposed the petition on the ground that the reduction of time period for inviting objections was not permissible.

The matter would be heard next on October 20.
