The Delhi High Court is continuing its hearing of the appeals preferred by the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) against the acquittal of all the accused in the 2G Spectrum case.
A Single-Bench of Justice Brijesh Sethi is hearing the appeals.
During yesterday's hearing, the CBI submitted that it had obtained prior sanction before preferring an appeal to the Court. Further, ASG Sanjay Jain was authorised to appear in Court and represent the CBI, it was informed.
The submissions came in response to an objection raised by Asif Balwa, one of the acquitted accused, who sought a copy of the Central Government's sanction letter to file the appeal against the acquittal of all the accused.
There was a further challenge as regards ASG Jain's appearance in the matter. As per a notification issued by the Central Government in February 2018, Solicitor General Tushar Mehta was appointed as the Special Public Prosecutor for all 2G Spectrum cases. However, the appeal was not filed through him or in his name, it was pointed out.
