Centre formed an opinion that 2G was a fit case for appeal, says CBI as it shows sanction order to Delhi HC [Live Updates]

A Single Judge Bench of Justice Brijesh Sethi had allowed early hearing applications by CBI, ED in the appeals and posted the matter for day-to-day hearing from Oct 5 onwards.

The Delhi High Court is continuing its hearing of appeals preferred by the CBI and Enforcement Directorate against the acquittal of all accused in 2G Spectrum case.

A Single-Bench of Justice Brijesh Sethi is hearing the appeals.

Yesterday, Asif Balwa, one of the acquitted accused, today sought a copy of Central Government's sanction letter which granted approval to Central Bureau of Investigation to file the appeal against the acquittal of all accused.

Appearing for Balwa, Advocate Vijay Aggarwal pointed out that the existence of the sanction/approval from the Central Government was a mandatory prerequisite under Section 378(2) CrPC as well as Chapter 23 of the CBI Manual.

ASG Sanjay Jain sought time to seek instructions on the issue of sanction.

There was a further challenge as regards ASG Jain's appearance in the matter. As per a Notification issued by the Central Government in February 2018, Solicitor General Tushar Mehta was appointed as the Special Public Prosecutor for all cases 2G Spectrum cases, Advocate Aggarwal argued.

However, the appeal was not filed through him or in his name, he added.
