Delhi Court on Wednesday rejected Delhi Police plea seeking three more days of police custody of Olympic wrestler Sushil Kumar in murder case and sent him to nine-day judicial custody instead. .The order was passed by Metropolitan Magistarte Rashmi Gupta, Rohini Courts after the expiry of Kumar’s four-day police custody remand period..While passing the order the Court observed,“Remand should only be granted when the situation so warrants it and it is justified. It should be granted only when the situation so warrants and it is justified. ”.Noting that Sushil Kumar had already spent ten days in police remand, the Court opined that there were no grounds made out for further extension of the same. .The Additional Public Prosecutor Raghav Khurana had argued that further custody of Sushil Kumar was required to inter alia recovery of mobile phones and clothes that the accused were wearing at the time of the incident. .The APP continued to explain that sincere efforts were being made to expedite the process and a grave offence had taken place which required extensive investigation..Per contra, the counsel for Sushil Kumar, advocate Pradeep Rana argued that the investigating agency was simply dragging the investigation to save face with the media and public at large as well as to win accolades from high-ranking officials..“This is a matter of his personal liberty. He is not a dreaded criminal; in fact, he is not a criminal at all. He has brought pride to the country and is a victim of the circumstances.”.Rana contended that no ground was made out in the application for further police custody..“They have not detailed any new grounds in the application. The previous application shows verbatim submissions. As per law, a special reason shall be made out in in the application and must be reflected in the case diary. Is 10 days not enough time to recover crucial evidence?”.Rana also accused the police of wasting precious judicial time and breaching fundamental rights of the accused and reiterated the role of Additional Public Prosecutor..“As per Hukumchand the Additional Public Prosecutor is not an agent of the investigating agency.
