A Delhi court has sent businessperson Navneet Kalra to 14-day judicial custody in oxygen concentrator black marketing case. .The plea by Delhi Police for further police custody of Kalra was rejected by Akanksha Garg, by Akanksha Garg, Metropolitan Magistrate, Saket Courts.."Whatever substantial had to be achieved by the investigating agency through the Police Remand of the accused has already been achieved and no fruitful purpose would be served by extending the Police custody of the accused.Therefore, I do hereby reject police remand application for above mentioned reasons," the Court said. .Additional Public Prosecutor Atul Srivastava had sought five more days of Kalra's custody. .The Court observed that although the offence in question was of grave nature and had serious implications upon the society at large, it was its "sacrosanct responsibility" to apply judicial mind to arrive at a decision. ."The Courts of law are not expected to be carried away by the public sentiment and therefore cannot authorise detention merely because some stringent and nonbailable sections have been slapped upon the accused by the prosecution," the Court remarked as it proceeded to conclude that no case for custodial investigation was made out. .The Court added that even if Kalra is remanded to judicial custody or enlarged upon bail, there would be no impediment on the investigating agency to confront or interrogate him. .The Prosecution had sought further custody of Kalra so as to confront him with the "transactions" existing in his mobile phone which has to be de-sealed and mirrored. .Further, Srivastava said that the bank accounts involved in the transaction were voluminous and time should be given to the investigating agency to complete the investigation. .Senior Advocate Vikas Pahwa opposed any further extension of remand stating that Kalra's custody was not required for further investigation. ."My technical assistance is not required for mirror image.. these data (on laptop) are available on the laptop. Bank statements are to be linked to the sale," Pahwa said. .In response to the Police claim that Kalwa was selling sub-standard oxygen concentrators, advocate Vineet Malhotra informed the Court that Bollywood actor Salman Khan also imported 500 such concentrators. .Drawing the Court's attention to a social media post by the actor, Malhotra said, "We've verified the fact. They are identical machines..".Srivastava, however, said that in Salman Khan's case, the oxygen concentrators were for charity and not sale. ."Salman Khan distributed free of cost. He has not made money. He never claimed it was premium oxygen concentrators and it was sufficient for two persons. He (Kalra) has fooled police officers also. Doing charity is not a crime," Srivastava said. .Kalra has also moved a bail application in the matter. The bail application would be taken up on May 22. .Kalra was arrested by the police on the evening of May 16 from his brother-in-law’s farmhouse in Gurugram.
