Delhi Court refuses to grant anticipatory bail to Olympic wrestler Sushil Kumar in murder case [Read order]

A Delhi Court on Tuesday refused to grant anticipatory bail plea to Olympic wrestler Sushil Kumar in a murder case being probed by the Delhi Police. .Additional Sessions Judge of the Rohini Courts Jagdish Kumar held that he was not inclined to grant anticipatory bail to Kumar at this stage in view of the statement of the eyewitnesses and the status of the investigation. ."The investigation is still going on and some of the accused persons have not been arrested so far. The NBWs has already been issued against the applicant/accused. The Court is not making any observations on the facts as submitted before because is the stage of anticipatory bail and giving any observation may prejudice the parties vice versa The statement of the eye witnesses are there. So at this stage, the Court does not inclined to grant anticipatory," the order said. .The Court added that the allegations against Sushil Kumar were serious in nature, and that the record showed that prima facie, he was the "main conspirator"..As per the prosecution's case, Sushil Kumar and other accused took one Sonu to Chhatarsal Stadium at gun point, and beat him up mercilessly. In the CCTV footage, Sushil Kumar was seen beating the deceased with a stick, the prosecution has stated. .It was submitted that Kumar's custodial interrogation was necessary to unearth the entire chain of events and to recover the weapon of offence..Non-bailable warrants were also issued as Kumar was not cooperating with the investigation, the prosecution claimed. .Seeking anticipatory bail, Sushil Kumar's counsel argued that the allegations against him were false, due to which the present FIR was delayed for about six hours..It was also contended that the Delhi Police had neither proved any motive behind the alleged crime nor ascribed any particular role to Kumar. .Special Public Prosecutor Atul Shrivastav appeared for the State.
