Customary divorce valid under Hindu Marriage Act if custom is proved and not against public policy: Chhattisgarh High Court
The High Court noted that sub-section 2 of section 29 of the Hindu Marriage Act, 1955 allows customary divorce and a Hindu marriage can be dissolved in accordance with custom.
The Chhattisgarh High Court recently ruled held that a Hindu couple can get separated by resorting to customary divorce and the same would be upheld if the custom is proved and is not against public policy [Duleshwar Deshmukh vs Kirtilata Deshmukh].
