Give complete details of criminal antecedents in bail orders: Rajasthan High Court directs trial courts

The Rajasthan High Court has directed courts in the State to specify whether a given bail applicant has a prior record of crime and details regarding the same in bail orders (Jugal v. State of Rajasthan)..It is often seen by this Court that the learned courts below are not specific in regard to antecedents of the accused persons, which causes delay in the disposal of the bail applications..Rajasthan High Court.A Single Judge Bench of Justice Dr. Pushpendra Singh Bhati made the direction when disposing of a bail application moved by a person who had no criminal antecedents. .The Bench pointed out that antecedent reports were crucial to deciding a grant of bail in cases where arrests are effected upon an accusation for a non-bailable offence. .Though these reports were not to be the basis of accepting or rejecting a bail application, these were necessary to draw a conclusion under Section 437 of the Code of Criminal Procedure (grant of bail for non-bailable offences), as well as to gain perspective on the accused vis-à-vis the allegations levelled. .The Court has now directed all trial courts in Rajasthan to give complete details about antecedents and record a finding as to whether the person had a criminal antecedents.....this Court directs that all learned trial courts shall, while allowing or disallowing any regular/anticipatory bail application of any accused person, give the complete details of the antecedentsRajasthan High Court.If the person had a criminal record, the trial courts were to specify the following in a chart and append it to the order alllowing/rejecting bail.FIR Number(s) Case Number(s),Section(s), Date(s), Status and Date of arrest and release. .The Court directed the Registry to communicate the order to district and sessions judges for immediate implementation in their jurisdictions.
