A criminal complaint has been filed against Maharashtra Chief Minister Eknath Shinde alleging discrepancy in the affidavits Shinde filed before the State Election Commission during the State Assembly Elections in 2014 and 2019..The complaint was filed by social activists Abhijit Khedkar and Dr. Abhishek Haridas. In the complaint filed through advocate Sameer Shaikh, it was stated that in 2014 Shinde deliberately failed to disclose the unit of equity shares owned by either him or his family members in the election nomination affidavit filed before the State Election Commission. The other discrepancies are listed in the image below:.The complainants also clarified that since filing proper affidavits before the Election Commission did not fall within the scope of duty of a public representative, there is no need to procure sanction from the authorities in order to prosecute Shinde. In this backdrop, the complainants sought the court to take cognizance of the complaint and initiate criminal proceedings against Shinde under Sections 199 (making false statements that can be used as evidence) and 200 (declaration that is known to be false) of the Indian Penal Code. The Chief Judicial Magistrate TM Ahmed will be verifying the claims made by the complainants with evidence and witnesses in the criminal complaint before summoning Shinde."Called on today. Complainant and his advocate present. Order Passed Exh.1 - Complainant to examine himself and witness, if any as per section 200 CrPC," the roznama (record of daily proceedings) said.
