Challenge to Section 12 DV Act proceedings sustainable only under Article 227 of Constitution: Madras High Court Full Bench

Since the ruling is prospective, cases that have already been transferred to family courts by previous orders of the High Court will not be sent back, the Full Bench said.

A full bench of the Madras High Court on Thursday held that proceedings under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (DV Act) can be challenged only under Article 227 of the Constitution and not under Section 482 of the Code of Criminal Procedure (CrPC).
