In a major development, two accused persons in the Aryan Khan drug case have secured bail..The two accused, Manish Rajgarhiya, Avin Sahu were granted bail subject to furnishing bail bonds to the tune of ₹50,000. Garhiya and Sahu are the first to secure bail in the case. The order was given by Special Judge VV Patil, who had earlier rejected the bail plea of Aryan Khan and certain other co-accused..Sahu was represented by Advocate Sana Raees Khan who argued that although there were factual similarities in the cases, considering Sahu and Khan were found without drugs, there were certain distinguishing features in their cases.The only evidence against Sahu was his own statement, which had already been retracted, his lawyer said..Rajgarhiya was represented by Advocate Tareq Sayed and Vikas Bhuwaniya who argued that Rajgarhiya was found with 2.4 gms of ganja. Sayed argued that since his arrest, no new material has come up and he was still charged only for consumption. The chain of drugs being passed from seller and buyer can be established only with investigation and there should be a common objective between all accused of conspiracy, Sayed contended..Special Public Prosecutor Advait Sethna opposed the arguments stating that the offences of the rigours of Section 37 applied in cases where there were Section 29 involved. .After hearing the arguments, the Special judge reserved the matter for orders and pronounced the same today. The detailed order will be made available tomorrow. .Meanwhile Khan's bail plea is currently being heard by the Bombay High Court.
