The Bombay High Court on Tuesday sought the response of the National investigation Agency (NIA) on a plea filed by Bhima Koregaon accused Surendra Gadling to attend his mother's funeral..Gadling had sought temporary bail from the Special NIA Court on the ground that his mother had expired in August 2020 and he was required to join his family members to perform the last rituals.However the application had been rejected by the Special Judge DE Kothalikar of Mumbai Court in September 2020.In view of this Gadling moved the High Court assailing the order and sought urgent temporary bail..Senior Advocate Indira Jaising, appearing for Gadling, submitted that it had been over a year and the funeral rites of his mother had not been conducted yet. She submitted that a funeral rites programme had been arranged on his mother's first death anniversary on August 15, this year. .Advocate Sandesh Patil appearing for NIA informed the Court that he had not been served with a copy of the petition. Directing that a copy be served to NIA by July 8, a Bench of Justice SS Shinde and NJ Jamadar then granted leave to NIA to file a response to the petition by July 20, 2021..Matter is posted for hearing on July 21, 2021. .Gadling was arrested in June 2018 and has been in custody since then. He challenged the September order of 2020 on the following grounds:.That the order passed by Special judge was bad in law and erroneous;That Gadling merely sought temporary bail for 3 weeks to attend a bereavement gathering; That due to the COVID pandemic, it was difficult to contact people to show proof that a bereavement gathering was organised, and in such a situation it was erroneous to insist on production of such proof;That the Special Court could have granted him a lesser period for bail if not for 3 weeks;That not allowing the petitioner to share his grief with his family affected his mental condition and was against his basic human rights. .Recently, through another report, US-based forensic firm, Arsenal Consulting, also revealed that Gadling’s computer was compromised for over 20 months by the same attacker identified in an earlier report.
