Don't bring in new jurisprudence that UAPA offences are to be tried by NIA Special Courts: State to Bombay High Court in Sudha Bharadwaj case

Advocate General Ashutosh Kumbhakoni submitted that a special court was constituted only to hear only those matters which were being investigated by NIA at a trial stage and not at a pre-trial stage.

The Maharashtra government on Thursday submitted to the Bombay High Court that the Special Courts under the National Investigation Agency (NIA) Act are only to hear matters which are being investigated by the NIA, and that regular courts were otherwise competent to hear cases under the Unlawful Activities (Prevention) Act.
