The National Investigation Agency (NIA) has opposed the extension application filed by Bhima Koregaon accused Varavara Rao in the Bombay High Court which has also sought modification of his bail conditions to enable him to reside in Hyderabad..NIA has opposed the plea for extension and modification on the following grounds:That medical reports do not disclose any major ailment that necessitates him to take treatment at Hyderabad; his medical condition does not form a ground for further extension. That Taloja jail authorities have been following the jail code and providing best medical facilities as per the jail manual. That surgery for hernia and cataract can be done in judicial custody under the supervision of the Government Hospital at Mumbai, hence there is no need of supervision for period of four months. That Rao had been provided with the best facilities at Nanavati Hospital on State expenses and hence the treatment at Hyderabad is strongly objected to. That the prayer for stay in Hyderabad was raised and adjudicated in the plea for interim bail, which was rejected by the Court. Hence, it is not permitted to raise the same point in the present application. There is enough proof in the medical records of Rao to show that the treatment which was given to him at the concerned hospital in Mumbai was upto the mark till date. That Rao took a treatment of his choice despite the fact that he was being provided proper treatment by the State as and when required. The conditions imposed by the High Court were considered after Rao submitted that he shall reside within the NIA jurisdiction. Cannot expect courts to pass orders as per their convenience, especially when the accused has been accused of committing serious offences. The medical report stated that he did not require indoor medical management and he was fit to be discharged.
