Bhim Army Chief, Chandra Shekhar Azad has moved the Additional Sessions Court at the Tis Hazari Courts Complex for modification of bail condition asking him to stay out of Delhi for the next four weeks.
While granting bail to Azad, Judge Kamini Lau had directed Azad to stay at his permanent residence in Saharanpur, Uttar Pradesh and mark his presence before the SHO concerned every Saturday.
Seeking to waive off the restriction of his presence in Delhi, Azad today informed the Court about the existence of his society which functions from New Delhi and works towards creating social and political awareness among the inhabitants of the city.
In his application filed through Advocates OP Bharti, MS Arya and Mahmood Pracha, Azad has stated that he is a social worker and founder of 'Bhim Army Bharat Ekta Mission'.
It further informed that the Bhim Army Society has its office at Aliganj, New Delhi and also holds a routine weekly meeting at Ambedkar Bhavan.
Azad has thus claimed that the Court's direction to not stay in Delhi would obstruct his right to attend the meeting of his society and hurt his "natural feelings and sentiments".
It is claimed that the restriction amounted to violation of his fundamental rights to take active participation in awareness camps and to advise and lead the poor, weak and downtrodden sections of society and minorities.
The application further states that being a social worker, Azad travels the entire country and was thus impossible for him to personally appear and report his presence before the local Police Station in Saharanpur in compliance with the bail condition.
Azad has also expressed his ability to comply with the third bail condition of informing the DCO, Delhi Police before his arrival in Delhi for medical treatment.
He has stated that in case of any emergency, it may not be appropriate for him to "seek permission" of the DCP at the risk of his life.
The Court today directed the Delhi Police to verify the address of Azad's Aliganj Society and place the report on record on the next date of hearing.
The matter would be taken up next on January 21.
