The Supreme Court on Wednesday refused to commute the death penalty handed down to Balwant Singh Rajoana who was convicted for the assassination of former Punjab Chief Minister Beant Singh [Balwant Singh vs Union of India]. .A bench of Justices BR Gavai, Vikram Nath and Sanjay Karol instead left it to the Central government's competent authority to deal with the mercy petition filed by Rajoana. The Court pronounced the verdict in a plea moved by Rajaona for commutation of the death sentence imposed on him due to the Central government's delay in deciding his mercy plea."It is, however, directed that the competent authority, in due course of time, would again as and when it is deemed necessary, may deal with the Mercy Petition, and take a further decision," the bench ordered. .It was opined that the argument regarding pendency of the mercy petition and there being a delay could not be sustained since Rajoana had not submitted the mercy plea himself, and the 2012 plea was filed by the Shiromani Gurudwara Prabandhak Committee. Further, the Court noted that the Home Ministry decided to defer the question of commutation after coming to the conclusion that it could have an impact of compromising the security of the nation or creating a law and order situation."It would not be within the domain of this Court to delve upon the decision of the competent authority to defer taking of any decision at present. It is within the domain of the executive to take a call on such sensitive issues.
