Availability of alternate remedy before Armed Forces Tribunal does not oust High Court's jurisdiction, Supreme Court
The Apex Court said that the principle that High Court would not exercise its jurisdiction when an alternate remedy is available is a rule of prudence, not a rule of law.
In a pertinent judgment, the Supreme Court on Thursday held that the availability of an alternate remedy before the Armed Forces Tribunal (AFT) does not take away the right of a High Court to exercise its jurisdiction under Article 226.
