44 years too long to maintain a legal action: Karnataka High Court dismisses 'stale' petition
Jurisdiction of High Courts under Article 226 of the Constitution is not liable to be exercised to entertain stale and virtually dead claims, the Court said.
Saying that forty-four years was too long a time to maintain a legal action, the Karnataka High Court recently said that it cannot be expected to exercise its jurisdiction on such “stale” or “virtually dead” claims.
