A Supreme Court bench led by Chief Justice of India (CJI) UU Lalit held a special hearing on Saturday to hear cases related to the Amrapali home buyers and the bail applications filed by its promoters. .The bench which also comprised Justice Bela M Trivedi extended the interim bail granted to Anil Kumar Sharma, ex-CMD of Amrapali Group of Companies by another eight weeks so as to enable him to undergo an eye operation."The interim relief granted to the petitioner shall continue to operate till eight weeks. Let the Operation upon the ‘Left Eye’ of the petitioner be conducted as per the medical advise, as early as possible. The petitioner shall be entitled to have the Operation conducted at Sankara Nehtralaya, if so advised," the order said.Another former director Shiv Priya's interim bail is set to expire on November 7 and he was asked to surrender on or before that date. "Since the medical condition of the daughter of the petitioner has improved, the protection by way of interim bail granted to the petitioner is withdrawn. The petitioner shall surrender before the Court [i.e. the Court of the Chief Metropolitan Magistrate (East), Karkardooma District Courts, Delhi] which had accepted bailbonds pursuant to the order of interim bail granted by this Court, on or before November 7, 2022 and he shall be taken in custody immediately," the Court directed..The Court also clarified that Shiv Priya's regular bail plea was not before it and the challenge to rejection of his regular bail application by trial court can be pursued before the appropriate forum."The petitioner may, if advised, take up the challenge insofar as rejection of bail application in the matter concerning offence under the Act is concerned, at the appropriate level," the order stated..However, the bench refused to grant bail to former Chief Financial Officer Chander Prakash Wadhwa and instead granted him liberty to file fresh bail application on the medical grounds, or challenge the earlier High Court order refusing bail..In 2017, home buyers of the Amrapali group of companies had moved the top court seeking various reliefs including compensation and refund of their money for delayed possession of their flats. Subsequently, several issues have came up in the matter including the investigation by various agencies into the alleged diversion of home buyers' money. In February 2019, the Supreme Court had allowed the Delhi police to arrest directors of the Amrapali for cheating homebuyers.The top court is also dealing with the completion of stalled projects of Amrapali Group which it has entrusted to state-run NBCC company and appointed a court receiver.[Read live thread].[Read Orders]
