The Allahabad High Court has recalled its September 6 order by which it had declined to hear a matter citing the "mischievous" behaviour of an advocate appearing before it. (Raja Ram v. State of Uttar Pradesh).A Division Bench comprising Justice Kaushal Jayendra Thaker and Subhash Chand recalled the order on a request made by Senior members of the Bar."Today, learned Senior members of the Bar and the learned President have requested us to recall the order though not requested by the counsel, who had misbehaved. While going through the record except F.A. No. 1028 of 1995, in no other matters delay condonation applications are allowed. Be that as it may, we recall the order dated September 6, 2021," the order passed by the Court on September 13 said..The court took suo motu cognizance of the bunch matters..Earlier the bench had directed that the matter should be listed before another bench that could tolerate the lawyer's behaviour."List before any other Bench which can tolerate the mischievous behaviour of the advocate who is practising for the last 40 years", stated the order passed on September 6..This Bench had dealt with this case at least once before, on August 31.
