Allahabad High Court denies bail to man accused of raping minor, forcing her family to convert to Islam [Read Order]

The Allahabad High Court recently rejected the bail of one, Abdul Rahman accused of raping a minor girl and forcing her family to convert into Islam (Abdul Rahman @ Golu v. State of UP).Single-judge Justice Ajit Singh said that the matter needs consideration and on the basis of the said allegation rejected the bail plea of the accused. "After considering the facts and circumstances of the case and considering the seriousness of the matter and minor daughter was raped and entire family was asked to convert their religion, without expressing any opinion on the merits of this case, this court does not deems it fit to release the applicant on bail.".The allegation against the accused was that he entered the house of the complainant and forcibly raped the minor daughter of the complainant when she was alone at her house.Further, it was alleged that Abdul also made a video clip of the victim and pressurized her for establishing physical relations with her again.When the complainant asked the father of the accused to get the video clip deleted, the father is alleged to have said "when your entire family will convert the religion then my son will marry to your daughter else I will marry her.".A First Information Report (FIR) was registered under Sections 452 (house-trespass after preparation for hurt, assault or wrongful restraint), 376 (rape) and 120-B (criminal conspiracy) of Indian Penal Code, Sections 3 (penetrative sexual assault), 4 (punishment for penetrative sexual assault), section 17 (abetment) and 18 (attempt to commit an offence) of The Protection of Children from Sexual Offences (POCSO) Act and Sections 3 (prohibition of conversion from one religion to another) and 5(1) (punishment for contravention of section 3) of UP Prohibition of Unlawful Conversion of Religion Act, 2020..The counsel for accused submitted that he is innocent and he has been falsely implicated due to party-bandi of locality and he is languishing in jail since January 26. .On the other hand, the Additional Government Advocate opposed the bail and submitted that the video clip which was made of minor victim had been taken in possession by the police during the investigation and the accused family also tried to pressurize the victim family to get converted..The Court opined that the allegations made were very serious and bail plea was rejected. .[Read order]
